These Terms of Service govern your use of the Kyro Care website (the “Site”), operated by Kyro Care Orange City LLC, doing business as Kyro Care (“Kyro Care,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these terms. If you do not agree to these terms, please do not use the Site.
Use of This Website
This Site is provided for general informational purposes about Kyro Care’s services, providers, and practice. You may browse the Site, request appointments, and contact our office through the tools provided, but you agree not to misuse the Site, interfere with its operation, or use it for any unlawful purpose.
Not Medical Advice
Content on this Site, including information about conditions and treatments, is provided for educational purposes only and does not constitute medical advice. It is not a substitute for a consultation, diagnosis, or treatment from a qualified healthcare provider. Care for Minors
Patients under the age of 18 must have the consent of a parent or legal guardian before receiving care at Kyro Care. We require a parent or legal guardian to be present at our office for a minor patient’s visit.
The parent or legal guardian providing consent must have legal authority to make healthcare decisions for the minor, and we may request documentation of guardianship or custody where appropriate. In the case of a medical emergency, we may provide care to a minor patient to the extent permitted by law, even if a parent or legal guardian is not immediately available.
Appointments & Scheduling
Appointments requested through this Site are subject to confirmation by our office. We require at least 24 hours’ notice to cancel or reschedule an appointment. Appointments cancelled or missed without at least 24 hours’ notice may be subject to a $35 no-show fee. Repeated missed appointments may affect your ability to schedule future visits.
Intellectual Property
The content, design, and materials on this Site, including text, graphics, and logos, are the property of Kyro Care or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written permission.
Third-Party Links & Services
This Site uses select third-party services to support your care, including Tebra for online appointment scheduling, SMS and email reminders for upcoming appointments, and Square for payment processing. We are not responsible for the content, accuracy, or practices of these third-party services, and your use of them is subject to their own terms and privacy policies.
Limitation of Liability
To the fullest extent permitted by law, Kyro Care shall not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, this Site. The Site is provided on an “as is” and “as available” basis, without warranties of any kind.
Changes to These Terms
We may update these Terms of Service from time to time. Changes will be posted on this page, and your continued use of the Site after changes are posted constitutes your acceptance of the revised terms.
Dispute Resolution
Before starting arbitration, you agree to first contact us in writing, either by email at billing@kyrocare.com or by mail to Kyro Care, 2705 Rebecca Lane Ste A, Orange City, FL 32763, with a description of the dispute, giving us an opportunity to resolve it informally within 30 days. If the dispute isn’t resolved within that time, either party may initiate binding arbitration as described below.
Right to opt out. You may opt out of this arbitration agreement. To do so, send written notice, by email to billing@kyrocare.com or by mail to Kyro Care, 2705 Rebecca Lane Ste A, Orange City, FL 32763, within 30 days of first agreeing to these Terms, stating that you decline to participate in arbitration. If you opt out, disputes will instead be resolved in the state or federal courts located in Volusia County, Florida.
Any dispute arising out of or relating to these Terms of Service or your use of this Site that isn’t resolved informally, and for which you haven’t opted out of arbitration, will be resolved through binding arbitration administered by the American Arbitration Association under its rules, held in Volusia County, Florida, and governed by the Florida Arbitration Code (Chapter 682, Florida Statutes). Arbitration will be conducted on an individual basis — you and Kyro Care agree not to bring claims as part of a class, consolidated, or representative action. Either party may instead bring a qualifying individual claim in small claims court.
Governing Law
These terms are governed by the laws of the State of Florida, without regard to its conflict of law principles.
